AI agent on WhatsApp: rules and costs in 2026

An AI agent on WhatsApp is an assistant that answers customers through the company's official number, connected to Meta's platform. It's allowed when the AI serves the business's own customer service. Since October 2026, each reply has its own cost, and the choice between Meta's agent and your own agent changes the rules of the game.

Three documents changed the subject. Meta's terms for the WhatsApp Business Platform were modified on September 23, 2026. The platform's pricing page was updated on September 30, with charges that started on October 1. And Cade, Brazil's antitrust authority, has been investigating AI chatbots' access to the app since January.

At Wama, every AI output goes through human review before reaching the client. In an agent that answers on its own, that review needs to be designed in advance: what it can say and when it hands the conversation to a person. The content the agent consults is the subject of the article on agents with a knowledge base.

What does Meta allow in an AI agent on WhatsApp?

Meta allows the agent that serves customers on behalf of the business and prohibits the general-purpose assistant distributed through the platform. Clause 4.7 of the terms bars AI providers, such as large language models and general-purpose assistants, when AI is the primary function of what they offer, rather than incidental or ancillary. Who decides what is primary, the text itself says, is Meta.

In an agent that answers order questions, books appointments or applies AI lead qualification, the AI is ancillary to customer service. That holds even when the agent looks up orders and schedules through the protocol that connects the agent to internal systems. The terms also allow the company to hire an AI provider as the integration vendor.

The restriction that remains is about data: conversations can't be used to create, train or improve third-party AI models. The exception is fine-tuning a model for the company's exclusive use, as long as it doesn't feed any other model. The contract with the vendor must prohibit using the conversations in the vendor's model, a topic tied to how the LGPD, Brazil's data protection law, treats data in an AI product.

What Cade decided about AI on WhatsApp

In Brazil, the rule against general-purpose assistants is suspended by Cade, but that changes nothing for your company's customer service agent. The case began in October 2025, when WhatsApp announced that, starting January 15, 2026, AI providers could no longer use the app's ecosystem.

In January 2026, Cade's General Superintendence opened an administrative inquiry and suspended enforcement of the new terms. On March 4, the Cade Tribunal upheld the preventive measure unanimously. On April 23, Cade upheld the daily fine of US$ 50,000 against the companies, on the understanding that charging AI chatbots per message reproduced, by other means, the effect of the suspended clauses.

Two takeaways matter for whoever is hiring. The dispute involves AI assistants offered to the public, not the agent that answers on behalf of a store or an office. And it's a preventive measure within an inquiry, not the final decision in the case.

How much does each reply cost since October?

Since October 1, 2026, Meta has resumed charging for service messages: the free-form replies sent within the 24-hour window opened by the customer's message. Each company number gets 1,000 free service messages per month, with no rollover. After that, you pay for replies from a person or from a third-party AI.

Replies from Meta Business Agent, Meta's own agent, have been a separate category since July 1, 2026, priced per token: US$ 2 per million. According to Meta, a message typically consumes 20,000 to 25,000 tokens, somewhere between 4 and 5 US cents, and these replies are charged even within the free inbound window.

There's also a deadline for anyone billed in Brazil: Meta requires providers and directly integrated businesses billed in the country to migrate all messaging accounts to Brazilian reais by June 30, 2027. After that, messages from accounts in another currency will no longer be delivered.

At Wama, whatever isn't written in the proposal is out of scope. In a WhatsApp agent, that includes Meta's invoice, which grows with volume: the proposal needs to say who pays and how usage is tracked. What else the contract should say is in the article on who owns the code of custom software.

Meta Business Agent or your own agent

Meta Business Agent is the shortest path, and your own agent is the most controllable. Meta introduced the agent in an announcement on June 3, 2026 and says more than one million businesses already use it on WhatsApp and Messenger. It learns from the website, the catalog and previous conversations.

The agent's developer documentation sets limits that weigh on the decision. On the platform, the number must be on a WhatsApp Business Platform business account, in good standing, in an authorized country and in an accepted category. Excluded are Finance, Government, Health, alcoholic beverages, gambling, over-the-counter drugs and matchmaking services. And the number can't have another AI agent active.

For fintechs, the message is direct: Meta's agent doesn't serve the Finance category, so the conversation is about your own agent, with the industry requirements covered in the article on AI in the fintech app. For everyone else, the trade-off is between speed of setup and control over the knowledge base, logging and integration.

What should you require from the vendor before switching on the number?

Require four answers in writing: who owns the account, where the conversations go, when a person takes over and who pays for each message. The table shows the answer that should raise a red flag.

A price with no mention of Meta's invoice

Eligibility

Does the company's category allow the chosen agent?

Exit

If I switch vendors, do I take the number, the knowledge base and the history?

Number locked to the vendor

In Wama's projects, the project is transferred to the client's account, and the client owns the website, the domain and the account. On WhatsApp, the logic is the same: the number, the platform account and the Meta portfolio belong to the company, and the vendor comes in as a partner with access, never as the owner.

The handoff to a person also carries legal weight. A fintech serving consumers needs to look at the rules of Brazil's customer service (SAC) decree for AI in support, which take effect on November 2, 2026. And what the team can paste into an AI tool day to day belongs in the company's AI use policy.

Common mistakes

  1. Confusing a customer service agent with a general-purpose assistant. The prohibition in the terms targets the second. Treating the two as the same thing mixes different risks.

  2. Doing the math with free messages. The limit of 1,000 service messages per number per month runs out fast in a high-volume operation. Without a payment method on file, Meta stops delivering messages after the limit.

  3. Turning on two agents on the same number. Meta's documentation blocks its agent on a number that already has another AI agent active. Decide the path before migrating.

  4. Leaving the agent without access to history. Without orders and previous conversations, it repeats questions. The integration with the company's CRM defines what it can read and what it can write.

Frequently asked questions

Can I use ChatGPT on my company's WhatsApp?

You can use an AI model inside your customer service agent, hired by the company or by a vendor. What Meta's terms prohibit is the provider offering the general-purpose assistant through WhatsApp. In Brazil that prohibition is suspended by Cade, but the company's customer service agent never depended on that dispute.

Does an AI agent on WhatsApp need the official API?

To integrate with systems, log conversations and hand off to the team with control, yes: the path is the WhatsApp Business Platform. The WhatsApp Business app offers Meta's agent to qualified businesses in selected markets, with quick setup, but limited to what the app itself allows.

How much does it cost to run an AI agent on WhatsApp?

There are three bills: Meta's messages, the AI model and the vendor. Since October 2026, each number gets 1,000 free service replies per month and, after that, each delivered message is charged. Meta's agent charges per token, about 4 to 5 US cents per message, according to Meta itself.

Can a fintech use Meta Business Agent?

According to Meta's developer documentation, no: the Finance category is among those excluded, along with Government and Health. A fintech that wants AI on WhatsApp needs its own agent on the platform, with logging, review and the industry rules, and with the handoff to human support designed from the start.

When should the agent hand the conversation to a person?

When it can't find the answer in the knowledge base, when the customer asks, when the subject involves money, a contract or a complaint, and when the conversation goes off the approved script. Meta Business Agent lets you define that moment, and your own agent needs the rule written into the project and tested with real conversations before going live.

If you're deciding how to bring AI to your company's WhatsApp, start with the account, the contract and the handoff rule, before the tool. To bring this list to your project, talk to Wama.
